Terms of Service

These Terms of Service (“Terms”) govern your access to and use of NewsletterOS, a product of iGloo Digital Services LLC (“NewsletterOS,” “we,” “us,” or “our”), available at newsletteros.live (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

NewsletterOS helps you scan a connected email inbox for relevant signal and produce a branded newsletter using AI-assisted tools. We may add, change, or remove features over time. Your use of data obtained from Google services is also governed by our Privacy Policy.

2. Eligibility & accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account. Notify us promptly of any unauthorized use.

3. Subscriptions, billing & refunds

Paid plans (such as Personal, Pro, and Agency) are billed on a recurring basis through our third-party payment processor. By subscribing, you authorize recurring charges until you cancel. Fees are stated at the time of purchase and may change with notice for future billing periods. Except where required by law, payments are non-refundable. You may cancel at any time; cancellation takes effect at the end of the current billing period.

You retain ownership of the content you provide or generate through the Service (“Your Content”). You grant us a limited license to host, process, and display Your Content solely to operate and provide the Service to you. You are responsible for Your Content and for having the rights necessary to use it, including any source material you incorporate into a newsletter.

6. Third-party services

The Service integrates with third parties, including Google (Gmail), AI providers, payment, hosting, and authentication services. Your use of those integrations may be subject to the third party's terms. Our use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements, as described in our Privacy Policy.

7. Intellectual property

The Service, including its software, design, and trademarks, is owned by iGloo Digital Services LLC and protected by law. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service; they do not transfer any ownership to you.

8. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. AI-generated output may be inaccurate or incomplete; you are responsible for reviewing content before you publish or rely on it. We do not warrant that the Service will be uninterrupted or error-free.

9. Limitation of liability

To the maximum extent permitted by law, iGloo Digital Services LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill. Our total liability arising out of or relating to the Service will not exceed the amount you paid us for the Service in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless iGloo Digital Services LLC from claims, damages, and expenses arising out of your use of the Service, Your Content, or your violation of these Terms.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Upon termination, your right to use the Service ends; sections that by their nature should survive will survive.

12. Governing law

These Terms are governed by the laws of the state in which iGloo Digital Services LLC is organized, without regard to its conflict-of-laws rules. The exclusive venue for disputes will be the state or federal courts located in that jurisdiction.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above, and your continued use of the Service after changes take effect constitutes acceptance.
